Terms and Conditions

The terms governing the use of our website and engagement of our gas appliance and piping services.

These Terms and Conditions ("Terms") govern your use of the website at closedeal.pro and your engagement of services provided by FlameGuard Technical Services Sdn Bhd (Registration No. 202201038476), a company registered in Malaysia, hereinafter referred to as "FlameGuard," "we," "us," or "our." The client, customer, or website visitor is referred to as "you" or "your."

Please read these Terms carefully before using our website or engaging our services. By accessing our website or entering into a service agreement with FlameGuard, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Acceptance of Terms

By using our website, submitting an enquiry, requesting a quotation, or engaging our services, you confirm that:

  1. You are at least eighteen (18) years of age or have obtained parental or guardian consent to enter into a binding agreement.
  2. You have the legal authority to enter into agreements on behalf of yourself or the entity you represent.
  3. You agree to comply with these Terms and all applicable Malaysian laws and regulations.
  4. The information you provide to us is accurate, complete, and current.

If you do not agree with any part of these Terms, you should discontinue use of our website and refrain from engaging our services.

2. Description of Services

FlameGuard Technical Services provides professional gas appliance and piping services in Malaysia, including but not limited to:

  • Gas appliance servicing: Routine maintenance, cleaning, calibration, and performance optimisation of gas-powered appliances including stoves, ovens, water heaters, boilers, and commercial kitchen equipment.
  • Diagnostics and inspection: Comprehensive assessment of gas appliance systems, safety compliance inspections, and performance diagnostics using industry-standard testing equipment.
  • Leak detection and repair: Identification of gas leaks in piping systems and appliance connections using electronic detection equipment, pressure testing, and visual inspection methods, followed by repair or replacement of faulty components.
  • Appliance installation: Professional installation of new gas appliances, including connection to existing gas supply lines, compliance testing, and commissioning.
  • Burner replacement: Removal and replacement of worn, damaged, or obsolete burner assemblies with compatible and approved components.
  • Safety sensor upgrades: Installation and calibration of modern safety devices including flame failure detectors, gas leak sensors, carbon monoxide detectors, and automatic shut-off valves.
  • Gas piping services: Installation, modification, extension, and repair of gas piping systems in residential, commercial, and industrial premises.

All services are performed by trained technicians in accordance with applicable Malaysian safety standards, Energy Commission regulations, and Department of Occupational Safety and Health (DOSH) requirements.

3. Quotations and Pricing

3.1 Quotations

All quotations provided by FlameGuard are estimates based on the information available to us at the time of assessment. Quotations are valid for thirty (30) days from the date of issuance, unless otherwise stated in writing. A quotation does not constitute a binding agreement until it is accepted by both parties.

3.2 Price Adjustments

Quoted prices may be subject to adjustment in the following circumstances:

  • The actual scope of work differs materially from what was described or apparent at the time of the initial assessment.
  • Additional faults, defects, or safety hazards are discovered during the course of service that were not visible or reasonably detectable during the initial inspection.
  • You request changes to the agreed scope of work after the quotation has been accepted.
  • The cost of parts, materials, or components changes due to supplier price adjustments or currency fluctuations between the date of the quotation and the date of service.

In all cases, we will inform you of any price adjustments and obtain your approval before proceeding with additional work or charges.

3.3 Payment Terms

Unless otherwise agreed in writing, payment is due upon completion of the service. For larger projects, we may require a deposit of up to fifty percent (50%) of the quoted amount prior to commencement. All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise. We accept payment by bank transfer, online transfer, cash, or such other methods as may be communicated at the time of service.

3.4 Late Payment

Invoices not settled within fourteen (14) days of the due date may incur a late payment charge of one and a half percent (1.5%) per month on the outstanding balance. FlameGuard reserves the right to suspend further services or withhold warranty coverage until all outstanding amounts are settled in full.

4. Service Scheduling and Access

4.1 Appointments

Service appointments are scheduled based on mutual agreement and subject to technician availability. We will make reasonable efforts to attend at the agreed date and time. However, scheduling is subject to change due to unforeseen circumstances including but not limited to emergency call-outs, traffic conditions, preceding jobs running over time, or adverse weather conditions.

4.2 Access to Premises

You agree to provide our technicians with safe, unobstructed access to the gas appliances, piping systems, and associated infrastructure that require servicing. This includes ensuring:

  • The work area is clear of personal belongings, obstructions, and hazards.
  • An authorised adult (aged 18 or above) is present at the premises throughout the duration of the service.
  • Parking facilities or loading access are available where heavy equipment or materials need to be transported.
  • Any building management approvals, access permits, or hot-work permits are obtained in advance where applicable.

4.3 Cancellation by Client

You may cancel or reschedule a service appointment by providing at least twenty-four (24) hours' notice. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee as outlined in our Return and Refund Policy.

5. Client Responsibilities

As our client, you are responsible for:

  1. Accurate information: Providing truthful and complete details about your gas appliances, piping systems, any known issues, previous repairs, and the history of the installation.
  2. Safety disclosures: Informing our technicians of any known hazards at your premises, including but not limited to asbestos-containing materials, structural weaknesses, electrical faults, pest infestations, or confined space risks.
  3. Compliance with regulations: Ensuring that any gas installations at your premises were originally carried out in compliance with applicable laws and building codes. FlameGuard is not responsible for rectifying unlicensed or illegal gas installations performed by third parties, except where you specifically engage us and agree to the cost of bringing such installations into compliance.
  4. Utility shut-off: Ensuring that the gas supply can be safely shut off at the main valve or meter when required for service work. If you are unable to locate or operate the shut-off valve, please inform us in advance.
  5. Post-service care: Following all post-service instructions, maintenance recommendations, and safety advisories provided by our technicians, whether delivered verbally, in writing, or through our service reports.

6. Warranty and Limitation of Liability

6.1 Workmanship Warranty

FlameGuard provides a warranty on workmanship for a period of thirty (30) days from the date of service completion, unless a different warranty period is specified in your service agreement or invoice. During the warranty period, if a defect attributable to our workmanship is identified, we will rectify the issue at no additional charge for labour.

6.2 Parts and Materials Warranty

Parts and materials supplied and installed by FlameGuard carry the manufacturer's warranty where applicable. The warranty period and coverage vary depending on the manufacturer and product. Details of the applicable parts warranty will be communicated to you at the time of service. FlameGuard will assist you with warranty claims against manufacturers where parts have been sourced and installed by us.

6.3 Warranty Exclusions

Warranties provided by FlameGuard do not cover:

  • Damage caused by misuse, neglect, accidental damage, or failure to follow post-service care instructions.
  • Damage resulting from unauthorised modifications, repairs, or tampering by persons other than FlameGuard technicians.
  • Normal wear and tear of appliance components and consumable parts.
  • Faults arising from pre-existing conditions that were not identified or disclosed at the time of service, including hidden defects in piping concealed behind walls or under flooring.
  • Damage caused by power surges, flooding, fire, pest activity, or other events beyond FlameGuard's control.
  • Appliances or systems that have exceeded their recommended operational lifespan as defined by the manufacturer.

6.4 Limitation of Liability

To the fullest extent permitted by Malaysian law:

  • FlameGuard's total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
  • FlameGuard shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, business interruption, loss of data, or damage to property not directly related to the service performed.
  • FlameGuard shall not be liable for delays in service delivery caused by factors beyond our reasonable control, including but not limited to parts supply shortages, regulatory approvals, force majeure events, or failure by you to provide the required access or information.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Malaysian law.

7. Intellectual Property

All content on the closedeal.pro website, including but not limited to text, graphics, logos, images, photographs, videos, icons, page layouts, and software, is the property of FlameGuard Technical Services Sdn Bhd or its content licensors and is protected by Malaysian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written consent, except for personal, non-commercial use such as printing a page for your own reference.

The FlameGuard name, logo, and all related product and service names, designs, and slogans are trademarks of FlameGuard Technical Services Sdn Bhd. You may not use these marks without our prior written permission.

8. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction to settle any dispute or claim arising from these Terms or the services provided by FlameGuard.

9. Dispute Resolution

9.1 Informal Resolution

In the event of any dispute arising from these Terms or our services, both parties agree to first attempt to resolve the matter informally through good-faith negotiation. You may contact us directly by email or phone to discuss any concerns, and we commit to responding within seven (7) business days.

9.2 Mediation

If the dispute cannot be resolved informally within thirty (30) days, either party may refer the matter to mediation under the rules of the Asian International Arbitration Centre (AIAC) or another mutually agreed mediation body. The costs of mediation shall be shared equally between both parties unless the mediator determines otherwise.

9.3 Legal Proceedings

If the dispute remains unresolved after mediation, either party may commence legal proceedings in the courts of Malaysia. Nothing in this clause prevents either party from seeking urgent interim relief (such as an injunction) from the courts at any time.

10. Amendments to These Terms

FlameGuard reserves the right to modify, update, or replace these Terms at any time. Changes will take effect immediately upon publication on our website unless a later effective date is specified. The "Last updated" date at the top of this page indicates when these Terms were last revised.

For existing service agreements already in effect at the time of any amendment, the Terms in force at the time the agreement was entered into shall continue to apply to that engagement unless you are notified of changes and given reasonable opportunity to object.

Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms.

11. General Provisions

11.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

11.2 Entire Agreement

These Terms, together with any specific service agreement, quotation, or invoice issued by FlameGuard, constitute the entire agreement between you and FlameGuard regarding the subject matter hereof and supersede all prior discussions, representations, and agreements.

11.3 Waiver

No failure or delay by FlameGuard in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A single or partial exercise of any right does not prevent further exercise of that right or any other right.
